New Regulation on Method of Determining Generation  Price, Procedures for Reviewing Power Purchase Agreement (PPA)

On 29 December, 2015, Ministry of industry and Trade (MOIT) issued Circular No. 51/2015/TT-BCT on amending and supplementing a number of articles of Circular 30/2014/TT-BCT dated 02 October 2014 on stipulating the operation of competitive power generation market and Circular No. 56/2014/TT-BCT dated 29/12/2014 of Minister of industry and Trade on stipulating the method of determining generation price and procedures for reviewing PPA

Accordingly, Circular No. 51/2015/TT-BCT on amending and supplementing a number of articles of Circular 30/2014/TT-BCT dated 02 October 2014 on stipulating the operation of competitive power generation market as stated below:

Revising clause 3, added clause 3a after clause 3 of Article 4 as follows: power plants that do not participate in the power market include: BOT power plants (having already signed or finished PPA’s in principle); renewable power plants excluding hydropower,  gas turbine power plants that are bound to maximally use the fuel gas to ensure national interests; co-generating power plants in the industrial parks selling part of power to the national grid, for which, the PPA was signed before 1 January, 2016 and this PPA is still valid after 1 January, 2016. "

 Circular No. 51 takes its effect from 01 January 2016.
